Terms and Conditions (st)Guest and all members of Guest's party (Guest's invitees) hereby agree to the following terms and conditions:
RENTER REQUIREMENTS: For legal and accounting purposes as well as for your own protection, the person placing the reservation must be the same as the credit/debit card holder. This person is considered to be the Guest. All other persons involved with the rental are considered to be the Guest's invitees. All discussions regarding reservation, check-in, payments, cancellation, and damage policies will be discussed with the Guest only, not the Guest's invitees. The Guest must be over the age of 30 and must comply with our policy of one (1) parent/guardian for every two (2) children under the age of twenty-five (25). Guest agrees to abide by the following policies of 20/20 Real Estate Services, Inc., the House Rules of the Owner and Condominium Association Rules as provided. The total number of occupants is limited to the number the unit is advertised to sleep. No exceptions. Guest may not sublet or assign this rental agreement. Violators of any of the above requirements are subject to eviction without refund, according to Florida Statute 509.141.
RESERVATION AND PAYMENTS: To secure your reservation, 20/20 Real Estate Services, Inc. must receive a signed Vacation Rental Agreement and a $200 non-refundable security deposit within twenty-four (24) hours. Guest will receive a confirmation e-mail immediately after the reservation is secured. For all rental stays less than fifteen (15) days, the remaining rental fee will be charged in full to your credit card thirty (30) days prior to your arrival date (or immediately if booked less than thirty (30) days in advance of Guest arrival). Once charged, all monies become non-refundable. For rental stays greater than fifteen (15) days, one half of all rental fees are due six (6) months prior to your arrival date. The remaining balance is due ninety (90) days prior to your arrival date (or immediately if booked less than ninety (90) days in advance of Guest arrival). Once charged, all monies become non-refundable. Guest will receive a confirmation e-mail acknowledging receipt of payment. Failure to make payments on a timely basis will make reservation subject to automatic cancellation. We accept Visa, MasterCard, and Discover only. We do not accept cash or checks.
CANCELLATION: Cancellation by guest of reservation at any time after payment will result in forfeiture of all monies. All cancellations must be requested and confirmed in writing. To protect against cancellations caused by certain unforeseen events, such as illness, death, natural disasters, etc., we recommend that Guests purchase Trip Cancellation and Interruption Protection insurance to assure reimbursement of vacation payments. Such insurance is available through travel agents, auto clubs such as AAA, or online at http://www.rentalguardian.com/ or http://www.csatravelprotection.com/. 20/20 Real Estate Services, Inc. reserves the right to cancel any reservations with a full refund to the guest for any units that the owner has withdrawn from the rental program or which 20/20 Real Estate Services, Inc., in its sole discretion, deems uninhabitable.
REFUNDS: Refund of monies charged shall only be made under the following circumstances: (1) if 20/20 Real Estate Services, Inc. is not able to relocate Guest to a comparable accommodation: (2) 20/20 Real Estate Services, Inc is able to re-book the property for the same time period and at the same rental rate as the initial booking, (3) the property is deemed unfit for habitation, (4) the property has been sold by the owner, (5) the property has been removed from our rental program, (6) access to the property by visitors has been prohibited by authorities, (7) see
HURRICANE POLICY: If a portion of the reserved dates is re-booked by another guest at a comparable rate, a pro-rata refund will be made. There will be NO refunds given due to housekeeping issues. Please notify our office immediately to have any cleaning concerns corrected. There will be NO refunds for early departures for any reason including inclement weather and evictions. All refunds, whether in whole or in part, are subject to a ten percent processing fee on all monies charged.
HURRICANE POLICY: It is the Guest's responsibility to remain informed about the forecasted weather in the area and follow all orders from the local authorities. In the event a mandatory evacuation is ordered for the City of Panama City Beach, the guest must evacuate. 20/20 Real Estate Services, Inc. will refund a pro-rated amount of your rental fees for the nights under a mandatory evacuation.
ACCIDENTAL DAMAGE WAIVER PLAN: Upon booking, you will be charged a non-refundable fee of $39.00 (included in your quote) for a limited Accidental Damage Waiver Plan which covers up to $1,000.00 of unintentional damages that could occur to the rental unit during your stay. Any unintentional damage MUST be reported to 20/20 Real Estate Services, Inc IN WRITING prior to check-out. Should any unintentional damage exceed $1,000.00, you authorize 20/20 Real Estate Services, Inc. to charge your credit card on file for the remainder of the cost to repair or replace said damage. If you do not report damage in writing before your departure, the damage is deemed intentional in nature, or there are items missing that were present upon your check-in, you will be responsible for the total cost of repair or replacement of said damage/items. This cost will be charged to your credit card on file. Please note: the Accidental Damage Waiver Plan does not cover extra cleaning that is required due to excessive dirt and/or disarray left upon your departure. Guest agrees that cleaning costs above and beyond the norm will be charged to your credit card on file.
CONDITION OF PROPERTY: Upon arrival, so as not to be charged, guest must immediately provide written notification to 20/20 Real Estate Services, Inc. of any existing damage in the unit. The unit must be left in the same condition as you found it upon check-in with the exception of normal wear. Guest must follow all checkout procedures provided in Welcome Packet and posted on the refrigerator in each unit. Guest shall be liable for all acts of the Guest's invitees, visitors or other persons invited onto the premises. When coming from the beach, 20/20 Real Estate Services encourages guests to wash off sand from feet and beach-related equipment by using the outside showers. No unsafe or unsightly conditions may exist on any premises or common area (i.e. beach towels hanging over railings). Due to fire code, beach chairs and related items cannot be stored on the walkway; they must be taken inside the unit.
CHECK-IN TIME IS 4:00 PM CENTRAL STANDARD TIME. CHECK-OUT TIME IS 10:00 AM CENTRAL STANDARD TIME (STRICTLY ENFORCED) A fee of $50 per hour (up to the total nightly rate including taxes) will be charged if you have not vacated the unit by 10:00 AM. NON-SMOKING: Smoking is strictly prohibited inside the rental unit as well as on the unit balcony. Evidence of such shall result in immediate eviction and your credit card will be charged for costs incurred to deodorize the unit as well as a $50.00 administrative charge. Please note: smoking is not allowed in common areas (hallways, decks, parking areas) although smoking is permitted on the beach itself.
NO DAILY MAID SERVICE: The housekeeper will clean the unit after your departure. An initial set-up of toilet paper, paper towel, Kleenex, shampoo, bath soap, lotion, dishwasher soap, liquid dish soap, and trash can liners are provided by 20/20 Real Estate Services, Inc,. These items will not be replenished during your stay.
FURNISHINGS: All properties are individually-owned. Decor, style, and inventories will vary from property to property. Bed linens, pillows, blankets, bedspreads and bath towels are provided in each rental property and are not to be taken from the unit. All units are equipped with a fully-stocked kitchen including, but not limited to dishes, glasses, cookware, coffee pot, and toaster. 20/20 Real Estate Services, Inc. makes every effort to keep each unit and its furnishings in proper working order. In the case of malfunction, we will strive to repair/replace the affected equipment as soon as possible after notification. 20/20 Real Estate Services, Inc. reserves the right to enter the premises at any time for the purpose of inspection and repair of reported items. No compensation or refund will be made for the mechanical failure of items including, but not limited to, refrigerator, air conditioning/heating system, dishwasher, microwave, washer/dryer, TV, DVD player or other appliances. Furnishings are subject to change without notice.
ALTERATIONS: Guest agrees not to make any alterations/improvements whatsoever to the unit, including moving furniture. Guest should also refrain from purchasing any items for the unit and understands there will be no reimbursement for such. Should Guest feel something essential is missing from the unit, please contact 20/20 Real Estate Services, Inc. right away. No furnishings or kitchen items are to be moved to another unit.
BEACH CHAIR SERVICE: Please note: Beach chair service is an elective service which each condo owner may or may not provide from year to year. If your unit currently has beach chair service, this is not a guarantee that it will have that service the following year. Condo owners generally decide and pay for this service each year towards the beginning of March. Therefore, 20/20 Real Estate Services, Inc. cannot guarantee beach service for any period beyond the current period for which it has been paid and is being advertised as an amenity to the unit. Please also note that beach chair service is generally active from March through September, but varies from one beach service provider to the next. Service generally ends at 5:00 pm each day and is not available to guests before check-in or after check-out. PARKING PASSES: Each vehicle must have a properly-displayed parking pass. Vehicles must be in operating condition and properly licensed to remain on the premises. Violations of these rules may result in the towing of vehicles at the Guest's expense.
RESORT REQUIRES WRISTBANDS: If you are staying at a resort that requires wristbands, they must be worn at all times while on the resort property. The rubber wristbands are reusable and must be left in the unit at the end of your stay. There will be a $25 charge for each missing rubber wristband. Paper wristbands are disposable. PETS: Dogs, and only dogs, are allowed to stay in units that are advertised as dog or pet-friendly. Guest must receive approval of the size and breed of his/her dog as there are certain restrictions in several units. The dog must be registered with 20/20 Real Estate Services, Inc. at the time of booking. The number and size of dogs present cannot exceed the advertised limit for the unit.
DOGS ARE NOT ALLOWED IN UNITS NOT ADVERTISED AS DOG-FRIENDLY. Cats are not allowed in any rental unit. If any evidence of an unauthorized pet is found in the unit, you will be asked to board the pet or vacate the premises immediately with
NO REFUND. UTILITIES: No compensation, refunds or adjustments will be given for temporary outage of electricity, gas, water, cable, telephone service or elevators because the operation and maintenance of these utilities is out of our control. Please report outages immediately to 850-588-7134 and all efforts will be made to have services restored as soon as possible.
A/C UNIT: All units are equipped with central heating and air conditioning. Do NOT run air conditioner with doors and windows open. This will cause A/C unit to freeze up and shut down. Guest who cause the A/C system to malfunction will be responsible for the service call, repair and restart charges. Please set A/C to a reasonable temperature.
AMENITIES: Amenities are to be used by Guest and Guest's invitees staying in the unit only. For your safety, Guest and Guest's invitees MUST follow all posted resort and amenity rules. Guest understands that there are certain inherent risks to person and property located adjacent to the gulf, including the possibility of drowning. Guest acknowledges that the owner would not rent the property unless the Guest accepted this condition. Guest and Guest's invitees agree to use the pool and other amenities at their own risk and shall not permit any use of pool or other amenities by unsupervised children or visitors. 20/20 Real Estate Services, Inc. cannot guarantee all amenities will be working properly or open during your stay. Occasionally amenities have to be closed due to maintenance issues, mechanical problems, or unexpected repairs that could occur without our knowledge. No compensation, refunds or adjustments will be made for any amenities not working properly at the complex during your stay.
BALCONIES: IT IS A FELONY TO THROW ITEMS FROM YOUR BALCONY; If you are caught throwing anything from any walkways or balconies, security will be called, you will be evicted with no refund and you will be charged for any damages. DO NOT feed birds from balconies, walkways, decks or beach as birds can transmit deadly diseases in their droppings. 20/20 Real Estate Services, Inc. will not be held liable for any related illnesses.
GRILLS: The Florida Fire Prevention Code prohibits the use of gas or charcoal grills on balconies. Violation of this code will result in eviction from the unit and forfeiture of rent. Only electric grills are allowed on unit balconies. If you are staying in a unit that has an electric grill, you must leave it clean for the next guest or your credit card on file will be charged $50.00 for the cleaning. Several complexes have designated community grilling areas. You are welcome to use the provided grills in the designated area only. Please be sure to clean up after yourself.
NOISE: Guest and Guest's invitees MUST be respectful of others and not conduct themselves in such a manner that will disturb or offend any neighboring occupants. If we receive reports of such behavior you will be evicted with no refund. 20/20 Real Estate Services, Inc. is not able to control noise coming from other people, other properties or nearby businesses. In the event you are disturbed by noise, we recommend you phone the local police. 20/20 Real Estate Services, Inc. is also not able to control when construction of any kind takes place whether it is in a neighboring unit, on the complex or a nearby street or business. No refunds or adjustments will be made for noise or construction that is out of our control.
PEST CONTROL AND MAINTENANCE SERVICES: In general, you will not be bothered by unexpected visitors during your stay, however; it is common in condominium associations for the units to have regular pest control and occasional maintenance service. These visits are often posted in the common areas and/or in the elevators. 20/20 Real Estate Services, Inc. has no control over when these service runs are completed, but would like you to know these services may have access granted, by the Homeowners Association, to the unit for these specific purposes. Due to the fact that we do not have exclusive access to the unit, 20/20 Real Estate Services, Inc. strongly encourages you to leave your valuables at home and cannot take responsibility for lost or stolen items.
INSURANCE: You understand that our insurance does not cover your belongings or damage that you cause. You agree that we are not responsible for any loss or damage during the term of the rental agreement. You agree to carry insurance covering all of your personal property located in the unit or bear full responsibility for its damage resulting from any cause, including damage from fire, water, theft.
LIMITATION OF LIABILITY: Under no circumstances shall 20/20 Real Estate Services, Inc. be responsible for any loss, expense, damages, claims or injury direct, indirect, consequential or otherwise whatsoever, howsoever caused or incurred, whether arising in contract or otherwise in law or equity as a result of rendering of the services or accommodations as described or substituted and including, without restricting the generality of the foregoing as a result of any delay(s), substitution(s), rescheduling(s) or change(s) in the provision of services or land accommodations by 20/20 Real Estate Services, Inc. or by reason of military actions, revolution or acts of God, government agencies, or unforeseen circumstances or events, by any agents, owners, employees, subcontractors, servants or services as substituted. While 20/20 Real Estate Services, Inc. and its Property Owners strive to maintain the Property in the finest conditions, no guarantees are expressed nor implied regarding suitability or for any particular purpose of the property. Guest and their invitees use the Property structures and premises at their own risk. 20/20 Real Estate Services, Inc. and its Property Owners shall not be held liable or otherwise responsible in any way for injury to any Guest and/or their invitees that is caused or permitted to be caused by the intentional or unintentional acts of said Guest and/or their invitees, or by the failure of structures, appliances, (including hot tubs and BBQs), furnishings, and/or other equipment, whether by malfunction, misuse, acts of God/nature, and /or are otherwise naturally occurring. No guarantees are expressed nor implied as to the suitability of utilities and other services provided to the Property and adjacent structures and premises. No guarantees are expressed nor implied regarding the suitability/compatibility of materials utilized in the construction of the property and/or its contents. Some activities in which Guests engage are especially dangerous and include scuba diving, snorkeling, deep-sea fishing, boating, golfing, swimming, boogie boarding, surfing, and biking. This list is not all-inclusive, but indicates some of the hazards of vacationing in Panama City Beach, Florida. Guests may also encounter the following risks: slippery floors and stairs, especially when wet, lanais with spaces between rails (dangerous for little children), precipitous drop-offs on ocean floor, un-fenced pools, faulty electrical or plumbing systems, gas/electric BBQ grills, clean/clear sliding glass doors, and dangerous stairs or pathways. Therefore, each Guest agrees that he/she is voluntarily participating in any and all activities, risks, and use of the accommodations, and hereby assumes all risk of injury, illness, damage or loss to person and property that might result, including, without limitation, any loss or theft of personal property. By booking this property, you acknowledge that in all events and circumstances, 20/20 Real Estate Services, Inc., its officers and employees shall not be liable. 20/20 Real Estate Services, Inc. reserves the right to cancel or rescind any rental agreement if it is found that the Guests are conducting unlawful activities, not abiding by the Homeowners Association Rules, disturbing others by playing loud music, percussion, audio or instruments, or cause any loud or offensive noises, have made any misrepresentations about the nature or size of the group or use of the group or the use of the property or any other misrepresentations or any other way in breach of the rental agreement. 20/20 Real Estate Services, Inc. reserves the right, in its sole discretion, to enter the premises at any time. 20/20 Real Estate Services Inc. and its Property Owners shall not be held liable nor otherwise responsible in any way for allergic reactions to Guest or invitees, caused or permitted to be caused by materials utilized in the manufacture of the Property and/or its contents, nor from mold and/or airborne spores, nor from pet/animal allergens, nor from chemical agents including, but not limited to appliances, linens, carpeting, utensils, fixtures, hot tubs, and/or other equipment. By written or electronic endorsement of this Vacation Rental Agreement, Guest and invitees hereby agree to forever hold harmless and indemnify 20/20 Real Estate Services, Inc. and its Property Owners from and against all claims, demands, loss, liability/responsibility of any kind and character, including cost of defense, arising out of or in any way connected with the Guest and Guest's invitees' use of the Property.
ARRIVAL INSTRUCTIONS: The Welcome Packet containing door access codes along with other specific condo information will be provided upon receipt of Final Payment.
